Rental Agreement & Terms of Service
Thank you for choosing Queen City Totes. Our goal is to make your move easier. This Rental Agreement is between 102123769 Saskatchewan Ltd., operating as Queen City Totes, and you the Customer. By reserving, renting, accepting delivery of, or using our moving totes and related equipment, you agree to the following Terms of Service:
1. RENTAL PERIOD
Your rental begins on the scheduled delivery date and ends on the scheduled pickup date.
Equipment must be available for pickup on the scheduled pickup date, unless an extension has been approved in advance.
Rental extensions must be approved 24 hours before the scheduled pickup date and are subject to availability.
(a) RENTAL RATES
The rental rates for totes are based on the quantity of totes rented and the duration of the rental, as set out on the QUEEN CITY TOTES website under the book now tab. The number of dollies provided with the rental is based on the quantity of totes rented, based on your order.
(b) EQUIPMENT ORDERED BY THE CUSTOMER
By placing an order, the customer agrees to inspect all rented totes, dollies, and related equipment upon delivery. The customer assumes full responsibility for the proper care, safe storage, and correct use of all rented property for the duration of the rental period. Equipment must be returned clean and in good working condition. The customer agrees to pay the replacement cost for any equipment that is lost, stolen, damaged, or unreturned beyond normal wear and tear.
2. PAYMENT
Full payment is required prior to delivery, unless otherwise agreed in writing. The remainder of balance is to be paid upon arrival.
Queen City Totes reserves the right to charge the payment method on file for any unpaid rental fees, late fees, cleaning fees, replacement costs, or damage charges. See Items (6. & 7.)
3. DELIVERY AND PICKUP CARE OF EQUIPMENT
Delivery and pickup times are estimated and are provided within 30-minute arrival windows.
A person of at least 18 years of age must be available to receive delivery and provide access for pickup, unless contactless delivery or pickup has been arranged.
Equipment must be empty, stacked, free of personal labels, and easily accessible on the scheduled pickup date.
If equipment cannot be collected at the agreed time due to circumstances attributable to the Customer, a return trip fee may apply. This includes, but is not limited to, the Customer requiring additional time, the equipment not being accessible for collection, changes to the agreed collection arrangements, unsafe conditions at the pickup location, or other delays caused by the Customer.
4. CARE OF EQUIPMENT
The Customer agrees to:
- Use the rental equipment only for household or business moving and storage purposes.
- Keep all totes clean, dry, and free from materials that may stain or damage.
- Store totes indoors and protected from weather conditions.
- Avoid dragging totes across rough, abrasive, or damaging surfaces.
- Not use excessive tape, adhesives, labels, or other materials that may damage or leave residue on the equipment.
- Not overload totes beyond their intended capacity or use them in a manner that may cause damage.
The Customer is responsible for any loss of or damage to the equipment beyond ordinary wear and tear while it is in their possession.
5. PROHIBITED USES
Rental equipment may not be used to store or transport:
- Hazardous or flammable materials
- Chemicals or toxic substances
- Perishable food that may leak or spoil
- Illegal items
- Live animals
- Construction debris, concrete, rocks, or similar heavy materials
- Materials that may damage the equipment
Customers are responsible for any damage resulting from misuse, negligence, or unauthorized use of the equipment.
6. LATE RETURNS
Equipment not available for pickup on the scheduled pickup date will be subject to late fees. Late fees will continue to accrue until the equipment is returned or collected, or until replacement costs have been paid.
Late fees include:
- $5 per tote per day; and
- $10 per dolly or moving equipment item per day.
7. CLEANING FEE
Equipment must be returned in reasonably clean condition.
A minimum cleaning fee of $25 will be charged if equipment is returned with excessive dirt, garbage, food residue, paint, strong odors, pet waste, or other contaminants.
8. LOST OR DAMAGED EQUIPMENT
The Customer is responsible for all rented equipment from the time of delivery until the equipment is returned or collected. The Customer will be charged for the repair or replacement of equipment that is lost, damaged, or returned in a condition beyond normal wear and tear.
Replacement charges may include:
- Standard Moving Tote – up to $30
- Dolly – up to $125
9. INITIAL PAYMENTS & MISCELLANEOUS CHARGES
Queen City Totes will require full payment of rental at time of booking.
The credit card on file may be used toward any amounts owing under this Agreement, including the:
- Late fees;
- Damage or loss;
- Cleaning charges;
- Missing equipment; and
- Unpaid invoices
10. CUSTOMER RESPONSIBILITY
The Customer is responsible for the safe and proper use of the equipment, including safe loading and unloading, using appropriate lifting and handling techniques, and securely packing and handling all items placed in the equipment.
The Customer is also responsible for ensuring that the equipment is not accessible to unauthorized persons and for taking reasonable steps to prevent loss, theft, misuse, or damage to the equipment while it is in their possession.
11. LIMITATION OF LIABILITY
To the extent permitted by law, Queen City Totes is not responsible for loss or damage arising from:
- Items packed, stored, or transported in the equipment;
- Improper packing, loading, or unloading by the Customer;
- Overloading, misuse, or improper use of the equipment;
- Delays caused by weather, traffic, equipment failure, or other circumstances beyond Queen City Totes' reasonable control.
The Customer assumes responsibility for the safe loading, unloading, packing, and use of the equipment and for the contents placed in the equipment.
12. CANCELLATION & RESCHEDULING
Cancellations made more than 48 hours before delivery will receive a full refund.
Cancellations within 24 hours may be subject to a cancellation fee of up to to 25% of the order. If rescheduled within the 24 hour period, Cancellation Fee may be waived.
Rescheduling is subject to equipment availability.
13. FORCE MAJEURE
Queen City Totes is not responsible for delays or failure to perform services caused by circumstances beyond its reasonable control, including severe weather, flooding, fire, road closures, labour disruptions, pandemics, unexpected equipment failure, or other events that could not reasonably have been anticipated or prevented.
14. GOVERNING LAW
This agreement is governed by the laws of the Province of Saskatchewan and the applicable laws of Canada.
15. SEVERABILITY
If any provision of this agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
16. ACCEPTANCE
By booking online, and approving of the rental agreement, paying an invoice, or accepting delivery of Queen City Totes equipment, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
